AN ORDINANCE ESTABLISHING THE WHITE PINE COUNTY NUCLEAR WASTE ADVISORY BOARD AND ESTABLISHING THE DITIES THEREOF; AND PROVIDING OTHER MATTERS PROPERLY RELATING THERETO.
WHEREAS, the Board of County Commissioners of White Pine County, State of Nevada, desire study and advice regarding the potential impact of Nuclear Waste Transportation through White Pine County; and
WHEREAS, the Board of County Commissioners of White Pine County, State of Nevada, is authorized to establish advisory boards by ordinance pursuant to N.R.S. 244.1945.
NOW, THEREFORE, the Board of County Commissioners of the County of White Pine, do ordain:
SECTION I
CODE ADDITION
There is hereby added to the White Pine County Code, a new chapter designated as Chapter 2.77, White Pine County Nuclear Waste Advisory Board, reading as follows:
2.77.010 Establishment. There is hereby established and created a White Pine County Nuclear Waste Advisory Board pursuant to N.R.S. 244.1948 as an advisory board to assist the Board of County Commissioners in evaluating the impact of Nuclear Waste being transported through White Pine County to the proposed Yucca Mountain Nuclear Waste Repository Site.
2.77.020 Membership. The White Pine Nuclear Waste Advisory Board shall consist of fourteen (14) members who shall represent a combination of the following entities:
White Pine County Fair and Recreation Board
City Council, City of Ely
Regional Transportation Commission
Ely Volunteer Fire Department
Municipal Water and Sewer Board
Overall Economic Development Plan
White Pine County Engineer
McGill-Ruth Consolidated Sewer & Water General Improvement District
White Pine County Public Works
White Pine County Sheriff
Department of Transportation
Regional Planning Commission
Emergency Management
Aviation
Economic Diversification
White Pine County Fire District
2.77.030 Terms of Office, Removal and Vacancies. The Term of office for the members of the Nuclear Waste Advisory Board shall be four (4) years and shall expire December 31st of their respective years. The terms of the members shall be overlapping and the membership of the Nuclear Waste Advisory Board first appointed shall include four (4) who shall serve until December 31, 1995; four who shall serve until December 31, 1994; three (3) who shall serve until December 31, 1993 and three (3) who shall serve until December 31, 1992.
Members may be removed, after a public hearing if requested, by a majority vote of the Board of County Commissioners of White Pine County for efficiency, neglect of duty or malfeasance of office.
Vacancies occurring otherwise than through the expiration of term of office shall be filled for the unexpired term.
2.77.040 Compensation and Expenses. Members of the Nuclear Waste Advisory Board shall serve without compensation, except for reasonable travel made necessary in the fulfillment of their official duties.
2.77.050 Chairman and Officers. The Nuclear Waste Advisory Board shall elect its Chairman from among the appointed members, and the term of such elected Chairman shall be one (1) year, with eligibility for re-election to successive terms.
The Advisory Board shall create and fill such other offices as it may deem necessary.
2.77.060 Expenditures. The expenditures of the Nuclear Waste Advisory Board, exclusive of any gifts received by it, shall be subject to, and within, the amounts appropriated for that purpose by the Board of County Commissioners, which shall provide the funds, equipment and accommodations necessary for the Nuclear Waste Advisory Board to work.
2.77.070 Meetings, Rules and Records. The Nuclear Waste Advisory Board shall hold such meetings as circumstances may require or render desirable for the performance of its functions and the proper discharge of its duties and responsibilities. A majority of the membership shall constitute a quorum for the purpose of transacting business. Action by the Advisory Board shall be by majority vote.
The Advisory Board shall keep a record of its resolutions, transactions, findings and determinations, which record shall be public record.
2.77.080 Duties. The Nuclear Waste Advisory Board shall serve as an advisory board to assist the Board of County Commissioners and the Nuclear Waste Coordinator regarding the impact of nuclear waste being transported through White Pine County, Nevada.
2.77.090 Reports and Recommendations. The Nuclear Waste Advisory Board shall make a report of its findings, determinations or recommendations to the Board of County Commissioners on all matters considered by said Nuclear Waste Advisory Board for final action and/or disposition by said Board of County Commissioners, as may be authorized under applicable law or ordinance.
No recommendation of the Nuclear Waste Advisory Board shall be binding on the County or the Board of Commissioners.
2.77.100 Place of Meeting. The Nuclear Waste Advisory Board shall meet pursuant to lawful notice at such locations as the Chairman of said Advisory Board deems convenient, including, but not limited to, nuclear waste outside White Pine County, Nevada.
SECTION II
REPEAL OF CONFLICTING ORDINANCES
Any or all ordinances or parts of ordinances heretofore adopted by the White Pine County Commissioners which are in conflict with this ordinance are hereby repealed.
SECTION III
SEVERABILITY
If any provisions of this Ordinance are held invalid, such invalidity shall not affect other provisions and each provision is hereby declared to be severable.
SECTION IV
EFFECTIVE DATE
This ordinance shall take effect from and after passage, approval and publication.

AN ORDINANCE AMENDING THE WHITE PINE COUNTY NUCLEAR WASTE ADVISORY BOARD ORDINANCE, ORDINANCE NO. 271, AMENDING THE MEMBERSHIP AND TERM OF OFFICE PROVISIONS; AND REPEALING CONFLICTING ORDINANCES AND PROVIDING OTHER MATTERS PROPERLY RELATING THERETO.
WHEREAS, N.R.S. 244.119 provides that the County Code may by ordinance regularly passed, adopted and published be amended or extended; and
WHEREAS, the White Pine County Board of County Commissioners is desirous of amending the membership and term of office provisiones of the White Pine County Nuclear Waste Advisory Board Ordinance, and
WHEREAS, the White Pine County Board of County Commissioners voted unanimously as a regular meeting held on February 10, 1993 to amend Ordinance No. 271 to modify the membership and term of office provisiones contained within the White Pine County Nuclear Waste Advisory Board Ordinance;
NOW THEREFORE, THE WHITE PINE COUNTY BOARD OF COUNTY COMMISSIONERS DO ORDAIN:
SECTION I

SECTION 2.77.020 IS HEREBY AMENDED TO READ AS FOLLOWS:

Section 277.030 IS HEREBY AMENDED TO READ AS FOLLOWS:
